A New York City jury determining the fate of Marine veteran Daniel Penny cannot reach a verdict.
“We the jury request instructions from Judge Wiley,” read a note from the jury. “At this time we are unable to come to a unanimous vote on count one.”
Penny is the 25-year-old hero who stopped a career criminal from attacking people on a subway car.
Penny put Jordan Neely in a chokehold after the homeless man threatened other passengers. There was an outstanding warrant for Neely’s arrest at the time of the incident.
Penny’s lawyers have said that the Marine veteran and aspiring architect was justified in protecting passengers from a man who witnesses said yelled “someone’s going to die today!” and said he was ready to go to jail after boarding the uptown F train.
Penny is facing manslaughter and negligent homicide charges after the city’s medical examiner concluded the chokehold killed Neely.
Every passenger on the subway car considers Penny to be a hero. And many fear other Good Samaritans will turn a blind eye if Penny is convicted.
